Stage win for Apple. In the bitter fought battle over market-shares Apple is taking first stage win in court.  ITC (International Trade Commission) found two HTC infringements on Apple patents. For the Android friendly giant could this bring mean some serious problems.

Apple gained some ground in the patent war the two companies are battleing. The US International Trade Commssion held that the taiwanese rival HTC copied Apple in two cases. Worst scenario would be an United States import ban.

HTC is one of Google’s closest partners in the world of smartphones and tablets. It’s has been more than 12 months Apple handed in a number of complaints claiming multiple infringements on their smartphone patents. Then about a month back Apple handed in second complaint, after HTC threw it’s Flyer tablet on the market.

Android is catching up…
And since Googles Android OS is being used by a wide range of the companies in the mobile-market on smartphones and tablets, it is catching up in big steps. Market researcher Comscore claimes the percentage of Android devices in the smartphones market are at 38.1 percent while Apple’s only at 26.6 percent. Apple is also battleling Samsung and Motorola for copying some “Apple owned ideas”.

HTC seems ready for battle. Grace Lei from HTC stated, that their prepared to fight with all weapons. The decision of the single ITC- judge has to be appoved by a commission, Lei went on “We’re sure to find alternative solutions to the complaints Apple brought up.

HTC is trying to turn it around and claims Apple infringed a HTC patent. On top of that HTC acquired the graphic specialists S3 (for $300 million) which won already some ITC patent cases against Apple.
